1. Acceptance of Terms

By accessing or using Rekindle's platform ("Rekindle," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the platform. These Terms constitute a legally binding agreement between you and Rekindle.

2. Description of Service

Rekindle is a guided reconciliation platform designed to help estranged family members explore and pursue reconciliation through structured assessment, storytelling, goal-setting, and outreach tools. The platform includes:

• A readiness assessment to help you reflect on your readiness for reconciliation
• Story-sharing tools for articulating your perspective privately
• Ideal outcome tools for defining your reconciliation goals
• Outreach tools including AI-generated message recommendations and delivery options
• An AI coaching companion ("Rekindler") for reflection and processing

The core assessment, story, and outcome features are provided free of charge. Optional paid features are available for one-time purchase.

3. Eligibility

You must be at least 18 years old to use Rekindle. By using the platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

Rekindle is not intended for use by children under 18, and we do not knowingly collect information from children under 18.

4. User Responsibilities

When using Rekindle, you agree to:

• Use the platform in good faith and with genuine reconciliation intent
• Not use the platform to harass, threaten, or harm any person
• Not use the platform to facilitate any illegal activity
• Not attempt to reverse-engineer, copy, or resell the platform or its content
• Provide accurate information when using the platform (though the platform does not require your real identity)
• Take full responsibility for any outreach messages you send through the platform to third parties

You are solely responsible for the content of any messages, letters, or communications you send through Rekindle. We do not review, approve, or take responsibility for any outreach messages you generate using our tools.

5. Paid Features & Refunds

Certain outreach features (including but not limited to AI-generated customized messages and delivery options) are available for a one-time fee. Prices are displayed on the platform before purchase.

All sales are final. We do not offer refunds on digital purchases once the message has been generated and made available to you. If you experience a technical issue with a paid feature, please contact us and we will work to resolve it.

Paid features are non-transferable and tied to your session. We do not guarantee delivery confirmation for physical mail or FedEx shipments.

6. Intellectual Property

The Rekindle platform, including its design, text, graphics, logos, and software, is owned by Rekindle and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from Rekindle's content without our written permission.

User-generated content — including the text of any outreach messages you compose — belongs to you. You grant Rekindle a limited license to use such content solely to provide the service (e.g., to deliver your message or generate your personalized landing page).

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using Rekindle, you agree to the terms of our Privacy Policy.

8. No Guarantee of Outcome

Rekindle is a tool to help you explore reconciliation — it does not guarantee any specific outcome, including reconnection with your family member. Reconciliation is a two-way process that depends entirely on the choices and readiness of all parties involved.

We make no representations that any outreach message will result in a response, a meeting, or any reconciliation outcome. Your family member has the absolute right to decline, ignore, or not respond to any outreach you send through Rekindle.

9. Disclaimer of Warranties

Rekindle is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, or completely secure. We do not warrant that any AI-generated content will be accurate, appropriate, or effective for your specific situation.

10. Limitation of Liability

To the fullest extent permitted by law, Rekindle and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform — including but not limited to damages for loss of data, goodwill, or emotional distress.

Our total liability for any claim arising from your use of Rekindle shall not exceed the amount you paid us for the specific paid feature at issue (if any), or $50 USD if you used the platform for free.

11. Account Termination

We reserve the right to suspend or terminate your access to Rekindle at any time, without prior notice, if we reasonably believe you have violated these Terms or engaged in activity that is harmful to other users, the platform, or third parties.

You may request deletion of your account and data at any time by contacting us at rekindle@polsia.app or via our contact form.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Rekindle shall be resolved in the state or federal courts located in California.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, for significant changes, display a notice on our homepage for 30 days. Your continued use of Rekindle after any change constitutes your acceptance of the revised Terms.
